CIRCULAR 21 / MODIFICATION PHASE 3

Dear clients,
We hereby inform you of two decisions adopted by the regional Government in sanitary and labour matters:
a) Decision of 18 August, which changes various sanitary measures affecting commercial activities and businesses, due to recent COVID-19 outbreaks. Among them:
– The consumption of tobacco on the street or in the open air is not allowed when a minimum interpersonal distance of at least two metres cannot be respected.
– Premises must display their maximum capacity, including their own employees, to the public, as well as “ensure that this capacity and interpersonal distance are respected”. They must also display “the opening hours, the obligation to observe the minimum interpersonal distance and the obligation to wear a mask, if applicable”.

Last Saturday, Real Decreto-Ley 24/2020 was published, which mainly extends the ERTEs/Procedures for the Temporary Suspension of Employment and the measures for autónomos/self-employed until September 30th.

ERTE/Procedure for the Temporary Suspension of Employment

  1. The possibility of submitting an ERTE/Procedure for the Temporary Suspension of Employment due to force majeure under Article 22 of Real Decreto-Ley 8/2020 (health situation derived from COVID-19) is finished.

However, it will be possible to benefit from an ERTEs/Procedure for the Temporary Suspension of Employment due to force majeure in the event of resurgence that affects the business’ activity.

Dear clients,

As you will be aware, as of today, Monday 8 June, the restrictions established following the declaration of the state of alarm (“phase 3″ of deescalation) are being relaxed in certain regions. Since the competent authority for the adoption of measures in the Balearic Islands, is the regional Government, the Decreto autonómico 3/2020 has implemented the Order of the Ministry of Health of 30 May.

We hereby inform you that last Friday new regulation was issued through which several health measures affecting commercial activities and establishments are again modified:

  • The use of masks in work centres will be mandatory:
    • In open spaces, if the interpersonal distance of 1.5 metres between employees cannot be maintained;
    • In closed spaces, if the interpersonal distance of 1.5 metres between employees cannot be maintained and there are no systems of physical separation between them; and
    • In “common areas“, in all cases.

It also becomes mandatory for customers in bars and restaurants, during waiting time and after dinner.
